By thrice seeking bankruptcy protection, Johnson & Johnson, one of the wealthiest companies in the world, sought to force victims who used talcum products to resolve their claims for pennies on the dollar in bankruptcy court, thereby depriving them of their right to a jury trial. If successful, the two-step strategy would have allowed the company to create a new under-funded subsidiary to assume liability for all existing lawsuits and then declare that entity bankrupt. This was a major win for talcum powder users afflicted with ovarian cancer or mesothelioma as, if successful, the ploy would have allowed the company to escape liability even though it has known the dangers of using talcum powder products for decades.
A significant number of new ovarian cancer cases are being filed every day. In the multidistrict litigation (MDL) pending in the District of New Jersey, the Court recently appointed a mediator to oversee settlement talks to ensure that representatives with full settlement authority are engaged in active good faith negotiations. Bellwether trials in the MDL are upcoming and the MDL Court recently ordered a census of all non-ovarian cancer cases, foreshadowing the likely dismissal of these cases, which would certainly facilitate settlement. Johnson & Johnson is fighting the cases on a second front in the state courts. The company’s stockholders would like to see the litigation end, but this will not happen any time soon given the $966 million dollar verdict that was recently entered against the company. Until Johnson & Johnson comes to the table, it can expect similar verdicts.
