My bicycle is my main form of transportation. I’m always very careful and I wear a helmet and obey all traffic laws when I’m riding my bike around New Orleans. I was recently hit by a car that ran a red light, and suffered multiple injuries. What should I do next? Do I need to look for accident lawyers?

Do bicycles have the same rights as vehicles

It sounds like you are doing everything you can to protect yourself by wearing a helmet and obeying all traffic laws. But did you know that motorized vehicle laws and bicycle road laws are the same? The National Highway Transportation Safety Administration (NHTSA) advises that “bicycles on the roadway are, by law, vehicles with the same rights, and responsibilities as motorized vehicles.”

Unfortunately, as you learned the hard way, you can’t rely on all motorists to follow the rules of the road. What’s worse is that, as a cyclist, you are at much greater risk for sustaining serious injury or being killed in an accident than you would if you were travelling in an enclosed vehicle. The Centers for Disease Control and Prevention (CDC) report that, in 2013, bicycle accidents in the United States accounted for an estimated 494,000 emergency department visits and over 900 bicyclist deaths.

So, even though riding a bicycle is an efficient and economical way to get around New Orleans, it is important to weigh the risks against the benefits, and consider other options. Check out the New Orleans Regional Transit Authority’s great public transportation system, with its ever expanding network of routes designed to better connect the city’s neighborhoods and commercial areas.

Now that the worst has happened to you, the most important thing is that you take care of you.

First, following an accident, check for injuries, and make sure you get the medical attention you need. It is also a good idea to report the accident to the police. An officer will respond to the scene and complete a report that will document your account of the accident, identify the parties involved, and include any witness statements.

The next step is to let us take care of you.
